These terms and conditions outline the rules and regulations for cancellation and refund requests for Smart CRM Solution, available at https://smartcrmsolution.com.
By purchasing or using any Smart CRM Solution plan, package, subscription, software setup, integration, onboarding, or related service, you agree to this Cancellation & Refund Policy.
1. 15 Days Refund Policy
For quarterly, half-yearly, and annual CRM rental/subscription plans, we may offer a refund within the first 15 days from the date of payment if we are unable to deliver the promised services or if the customer is unable to adapt to the software after reasonable use.
To process any refund request, we may request the customer to participate in a brief feedback or support call so that our team can understand the concern, try to resolve the issue, and improve our services.
Important: This refund policy applies only to the eligible CRM rental/subscription amount. Any one-time Software Setup Fee included in the plan, package, onboarding, or implementation process will remain strictly non-refundable.
Refund approval will be subject to review by the Smart CRM Solution management team.
2. Monthly Plan Refunds
Monthly rental/subscription plans are non-refundable.
In specific cases where the sales team has offered a one-time trial on a monthly subscription plan, this policy will still apply, and no refund will be granted for the monthly plan unless specifically approved in writing by Smart CRM Solution.
3. One-Time Software Setup Fee
Any one-time Software Setup Fee charged by Smart CRM Solution as part of the selected plan, package, onboarding, or implementation process is strictly non-refundable.
The Software Setup Fee covers technical setup, manual configuration, onboarding support, and implementation work required to activate and configure the customer’s CRM account.
This may include, but is not limited to:
- WhatsApp API setup
- Facebook/Meta lead integration setup
- API setup or integration
- Employee role setup
- User access setup
- Custom tags setup
- Custom fields and lead status setup
- CRM configuration
- Onboarding and implementation support
- Other technical setup or configuration services requested by the customer
Since this work involves technical effort, manual configuration, third-party coordination, and service time, the one-time Software Setup Fee will not be refunded once the setup process has started or has been completed.
Only the CRM rental/subscription amount may be considered for refund as per the applicable refund policy. The one-time Software Setup Fee, integration fee, onboarding fee, customization fee, and any third-party charges will not be included in the refundable amount.
4. Pro-Rated Refunds
In circumstances where promised features are not being delivered, Smart CRM Solution may consider granting a refund for the unused subscription period.
For example, if a customer has purchased an annual plan and after three months a promised feature is not delivered as committed, the customer may raise a refund request with our support team. Smart CRM Solution will aim to resolve the issue within a reasonable period, generally up to 30 days.
If the issue remains unresolved after the review and resolution period, Smart CRM Solution may provide a refund for the remaining unused subscription period. This will apply only to the eligible CRM rental/subscription amount and will not include any one-time Software Setup Fee or other non-refundable charges.
All pro-rated refunds are subject to the sole discretion of the Smart CRM Solution management team.
5. No Refund Upon Misunderstanding or Misconduct
Refunds will not be provided in cases where the customer has misunderstood the product features, did not properly review the demo, or did not clarify requirements before purchase.
Refunds will also not be provided in cases of inappropriate behavior, abusive communication, misconduct with the support team, repeated unreasonable demands, or requests for support outside designated support hours.
This includes situations where a customer demands a refund due to disagreement with the team, lack of cooperation during onboarding, or failure to provide required details for setup.
6. No Refund in Certain Cases
Refunds will not be applicable in the following cases:
- The customer changes their mind after purchase.
- The customer does not use the CRM after activation.
- The customer delays or refuses to provide required details, access, documents, OTPs, or approvals.
- The customer does not provide Facebook/Meta access, WhatsApp details, website details, employee details, or API-related information required for setup.
- Third-party approval is delayed or rejected by platforms such as Meta, WhatsApp, Facebook, Google, IndiaMART, Justdial, or any other external platform.
- The issue is caused by customer-side internet, device, staff usage, browser settings, mobile permissions, incorrect data entry, or lack of internal training.
- The customer has already used the CRM for lead management, calling, WhatsApp automation, reporting, team management, or other active business operations.
- The refund request is raised after the eligible refund period.
7. Third-Party Charges
Any charges paid to third-party platforms, service providers, APIs, WhatsApp Business API providers, Meta, payment gateways, SMS/email providers, hosting providers, or other external tools are non-refundable.
Smart CRM Solution does not control the refund policies, approval timelines, service availability, or technical decisions of third-party platforms.
8. Case-by-Case Evaluation
All refund requests will be evaluated on a case-by-case basis. We are committed to customer satisfaction and will make reasonable efforts to resolve genuine concerns before taking a final decision on any refund request.
The final decision regarding refund eligibility, refund amount, deductions, and approval will remain with Smart CRM Solution management.
9. Refund Processing Timeline
If a refund is approved, the eligible amount will be processed within 7 to 10 working days from the date of approval.
Refunds will be processed through the original payment method or any other method approved by Smart CRM Solution.
10. Cancellation of Subscription
Customers may request cancellation of their CRM subscription by contacting Smart CRM Solution support. Cancellation does not automatically make the customer eligible for a refund.
If a subscription is cancelled, access to the CRM may remain active until the end of the paid billing period, unless otherwise decided by Smart CRM Solution.
11. Changes to Our Cancellation & Refund Policy
Smart CRM Solution may update, revise, or modify this Cancellation & Refund Policy from time to time. If we decide to change our Cancellation & Refund Policy, we will post those changes on this page.
12. Governing Law, Arbitration and Jurisdiction
These conditions shall be governed by and construed in accordance with the laws of India.
In the event of any dispute, claim, difference, or controversy arising out of or in connection with this Cancellation & Refund Policy, the services provided by Smart CRM Solution, any subscription, software setup, onboarding, integration, payment, refund, or related matter, the parties shall first attempt to resolve the matter amicably through discussion and written communication.
If the dispute is not resolved amicably, the matter shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, and any amendments applicable at the time. The arbitration shall be conducted by a sole arbitrator appointed as per applicable law. The seat and venue of arbitration shall be Delhi, India. The language of arbitration shall be English or Hindi, as may be mutually decided by the parties.
Subject to the arbitration clause above, all disputes, claims, proceedings, and legal matters arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts and tribunals located in Delhi, India.
